Family members of Spanish nationals or residents in Spain

Family members of Spanish nationals or of foreign nationals residing in Spain can also regularise their situation and reunite with the person who lives, or lives and works, in Spain. The requirements tend to be stricter when the tie is with a foreign resident than with a Spanish or EU citizen, but in either case the possibility exists.

A foreign national can reunite with their minor or incapacitated children, their spouse and their ascendants, that is, their parents.

With the spouse and minor or incapacitated children, after residing in Spain for at least one year: once the first renewal has been granted, that is, with one year on the card and the renewal for two years. With parents, only as a long-term resident: at least five years of lawful residence in Spain.

Having worked for at least the last six months, ideally with proof of the whole year, and having a minimum income that depends on the people to be reunited: a reference amount for the spouse, increased for each additional member, according to the applicable legal threshold, which changes every year.

First of all, the family tie: the children's birth certificates; for the spouse, an up-to-date marriage certificate, which expires after three months; for parents, the sponsor's birth certificate. Then the financial means according to your employment situation, the housing and healthcare cover.

Self-employed

Proof of the activity: forms 130 or 131 of the instalment payments on account of personal income tax (IRPF) for the last four quarters and, where applicable, the last income tax return.

Employees

A copy of the employment contract and the last six payslips; where applicable, the last income tax return.

Not working in Spain, with own means

Certified cheques, traveller's cheques, letters of payment or credit cards with a bank certificate of the available credit, or a bank certificate.

Housing, healthcare and passports

  • Adequate housing report, normally issued by the town council of the place where the sponsor lives, together with the title of occupancy: purchase contract, land registry extract (nota simple) or rental contract.
  • Joint municipal registration certificate: it counts how many people live in the home and whether its rooms allow reunification. The people registered also count for the financial means: if they have their own means, it must be proven that they work and do not live off the sponsor's income; otherwise the Immigration Office will assume they all live off it.
  • Public or private healthcare: the health card or the terms of the private medical insurance with the last receipt paid.
  • Full passports in force for the sponsor and for the family members to be reunited.
