Residence for minor children
The children of foreign nationals residing lawfully in Spain can obtain a residence authorisation, whether or not they were born in Spain, provided they have no right to acquire the nationality of a European Union country. Minors born in Spain receive an authorisation similar to their parents', if the parents are in a lawful situation; the application can be filed from birth or from the moment one of the parents obtains legal residence.
If the father or mother has refugee status, a choice can be made between extending the international protection and a residence authorisation, in the best interests of the child. In certain cases the minor can also obtain residence through family reunification, if one of the parents holds that authorisation.
How to apply
With the official form, completed and signed by the father or mother who is a legal resident in Spain, filed in person at the Immigration Office of the minor's place of residence, normally in duplicate.

- Completed official application form.
- The minor's full passport, travel document or registration certificate in force, original and copy.
- The minor's birth certificate.
