Investors and Entrepreneurs

One of the most widely used authorisations for obtaining residence in Spain among those provided for in the law on entrepreneurs and their internationalisation: anyone who makes a significant investment in Spain obtains a residence and work permit very quickly, with more advantages than the other permits under immigration law.

  • Renewal does not depend on whether or not you reside in Spain: you can leave and enter the country as often and for as long as you wish.
  • It can be applied for both in Spain and in the country of origin or residence.
  • Applied for in Spain, during a lawful stay, it directly grants two years of continuous residence, and the next renewal is already for five years.
  • It can be filed together with the family unit, at the same time or afterwards, in Spain or in the country of residence.

  1. Investment in one or more properties located in Spain for an amount equal to or above the applicable legal threshold.
  2. Investment in Spanish companies or financial institutions according to the applicable legal threshold.
  3. Investment in a business project in Spain: no minimum amount; it is assessed on its impact on job creation, its socio-economic impact or its significant contribution to scientific innovation.
  4. Investment funds or deposits according to the applicable legal threshold.
  5. Purchase of public debt according to the applicable legal threshold.

  1. Application form.
  2. Full passport in force.
  3. Sufficient financial resources for the investor and their family during their residence in Spain, according to the applicable legal threshold, plus the corresponding amount for each family member.
  4. Residence card in force, or within 90 days after its expiry, or a lawful stay on a tourist visa or another visa that allows you to be in Spain.
  5. Criminal record certificate, apostilled or legalised and translated, from the country of origin and from the countries of residence of the last five years, only if you are in Spain as a tourist or on a study stay of less than six months.
  6. Health insurance, public or private, with an insurer authorised in Spain, full and without co-payments, unless your activity gives you insured status under the National Health System.
  7. Proof of payment of the fee (form 790-038).

Property or housing

Certificate of title and charges from the Land Registry for the property or properties (for the legal minimum amount), dated within the 90 days before the application; the minimum amount must be free of charges and only the excess may be mortgaged. If the purchase has not yet been completed, the following may be filed:

  • A preliminary contract with a performance guarantee (a deposit contract or another means admitted in law, in a public deed).
  • A certificate from a financial institution established in Spain of a blocked bank deposit for the amount needed for the purchase, charges and taxes.

Companies, funds, deposits or public debt

The minimum investment, made no more than one year before the application, must be proven:

  • Unlisted shares or company shares: the investment declaration filed with the Foreign Investment Register of the Ministry of Economy and Competitiveness.
  • Listed shares: a certificate from a financial intermediary registered with the CNMV or the Bank of Spain confirming that the investment has been made.
  • Public debt: a certificate from the financial institution or the Bank of Spain confirming that the applicant is the sole holder of the investment for a period of five years or more.
  • Investment funds, closed-end funds or venture capital funds established in Spain: a certificate from the management company, registered with the CNMV, of an investment equal to or above the applicable legal threshold.
  • Bank deposit: a certificate from the financial institution confirming that the applicant is the sole holder of the deposit.

Business project

No minimum amount: it is assessed on its impact on job creation, its socio-economic impact or its contribution to scientific innovation. A favourable report from the Economic and Commercial Office of the district where the application is filed, confirming reasons of general interest, is required.

They can file their documentation at the same time as the investor or afterwards.

Documentation

  • Application form and full passport in force.
  • Sufficient financial resources: the legal threshold applicable to the main holder plus the corresponding amount for each family member, provable by any means of evidence (bank certificate, employment contract, the holder's professional relationship, property income, shares, etc.).
  • Family tie with the holder: spouse or registered partner (marriage certificate, cohabitation certificate or registration in the Register of Domestic Partnerships); minor or dependent adult descendants (birth certificate and, for adults, proof of financial dependence and that they do not form an independent family unit); dependent ascendants (the tie and proof that they are dependent on the holder).
  • Residence or stay card in Spain, where applicable.
  • Criminal record certificate, apostilled or legalised and translated, from the country of origin and from the countries of residence of the last five years, only for a tourist stay or a study stay of less than six months.
  • Health insurance, public or private, with an insurer authorised in Spain, unless covered as a beneficiary of the National Health System through the holder's activity.
  • Proof of payment of the fee (form 790-038).

  • During a period of residence or lawful stay in Spain: with the Large Companies and Strategic Groups Unit (UGE).
  • Outside Spain (Golden Visa): at the Spanish Consulate in the country of origin or residence.

It does not require continuous residence or tax residence in Spain, but the holder must enter the country at least once a year. It carries an authorisation to work as an employee and self-employed, and to start any professional or business activity, for the holder and for family members of working age.

  • Visa applied for in the country of origin or residence: one year.
  • Initial authorisation: two years.

The card is renewed on expiry: from 60 days before to 90 days after it expires, preferably before. It is filed with the Large Companies and Strategic Groups Unit (UGE). The renewal authorises residence for five years.

Documentation

  • Investor residence authorisation in force, or at most within 90 days after its expiry.
  • Maintenance of the investment: for property, a certificate of title from the Land Registry dated within the previous 90 days; for shares, funds or deposits, a certificate dated within the previous 30 days confirming that an investment equal to or above the minimum amount is maintained.
  • Sufficient financial means for the family unit during the stay, in the same amounts as in the initial application.
  • Medical insurance, public or private, with cover in Spain, full and without co-payments.
  • Proof of payment of the fee (form 790-038).
